ਲਕਸ਼ਮੀਨਾਰਾਇਣਨ ਨੇ ਇਸ਼ਾਰਾ ਕੀਤਾ ਕਿ ਸੁਪਰੀਮ ਕੋਰਟ ਨੇ ਤਾਮਿਲਨਾਡੂ ਸਕੂਲ &lpar;ਫ਼ੀਸਾਂ ਦੀ ਉਗਰਾਹੀ ਦਾ ਨਿਯਮ&rpar; ਐਕਟ&comma; 2009 ਦੇ ਸਿਰਫ਼ ਹੋਰ ਉਪਬੰਧਾਂ ਨੂੰ ਟਾਲਿਆ ਹੈ&comma; ਪਰ ਧਾਰਾ 7&lpar;3&rpar; ਨੂੰ ਟਾਲਿਆ ਹੈ&comma; ਜੋ TNPSFDC ਨੂੰ ਤਸਦੀਕ ਕਰਨ ਦਾ ਅਧਿਕਾਰ ਦਿੰਦਾ ਹੈ। &period; &comma; ਇਸ ਲਈ&comma; ਕਮੇਟੀ ਕਾਨੂੰਨ ਦੇ ਵਿਸ਼ੇਸ਼ ਉਪਬੰਧ ਦੇ ਤਹਿਤ ਆਪਣਾ ਵਿਧਾਨਕ ਕੰਮ ਕਰਨਾ ਜਾਰੀ ਰੱਖ ਸਕਦੀ ਹੈ।<&sol;p>&NewLine;<p>ਇਹ ਸਪੱਸ਼ਟੀਕਰਨ ਉਦੋਂ ਦਿੱਤਾ ਗਿਆ ਜਦੋਂ ਚੇਨਈ ਵਿੱਚ ਆਸਨ ਮੈਮੋਰੀਅਲ ਐਸੋਸੀਏਸ਼ਨ ਦੀ ਨੁਮਾਇੰਦਗੀ ਕਰਨ ਵਾਲੇ ਇੱਕ ਵਕੀਲ ਨੇ ਕਿਹਾ ਕਿ ਟੀਐਨਪੀਐਸਐਫਡੀਸੀ ਨੇ ਸੁਪਰੀਮ ਕੋਰਟ ਵਿੱਚ ਲੰਬਿਤ ਅਪੀਲਾਂ ਦੇ ਨਿਪਟਾਰੇ ਤੱਕ ਸੀਬੀਐਸਈ ਅਤੇ ਆਈਸੀਐਸਈ ਸਕੂਲਾਂ ਨਾਲ ਸਬੰਧਤ ਮੁੱਦਿਆਂ ਦੀ ਜਾਂਚ ਨਾ ਕਰਨ ਦਾ ਫੈਸਲਾ ਕੀਤਾ ਹੈ। ਜੱਜ ਨੇ ਲਿਖਿਆ&comma; &&num;8220&semi;ਜਦੋਂ ਸੁਪਰੀਮ ਕੋਰਟ ਨੇ ਧਾਰਾ 7&lpar;3&rpar; ਤੋਂ ਇਲਾਵਾ ਸਿਰਫ਼ ਹੋਰ ਵਿਵਸਥਾਵਾਂ &&num;8216&semi;ਤੇ ਰੋਕ ਲਗਾਈ ਹੈ&comma; ਤਾਂ ਮੈਂ ਪੇਸ਼ੀ ਨੂੰ ਸਵੀਕਾਰ ਕਰਨ ਦੀ ਸਥਿਤੀ ਵਿੱਚ ਨਹੀਂ ਹਾਂ।&&num;8221&semi;<&sol;p>&NewLine;<p>ਇਹ ਟਿੱਪਣੀਆਂ ਅਸਿਸਟੈਂਟ ਸਿਟੀ ਸਿਵਲ ਕੋਰਟ ਦੇ 1 ਅਗਸਤ&comma; 2024 ਦੇ ਆਦੇਸ਼ ਦੇ ਖਿਲਾਫ ਐਸੋਸੀਏਸ਼ਨ ਦੁਆਰਾ ਦਾਇਰ ਸਿਵਲ ਰਿਵੀਜ਼ਨ ਪਟੀਸ਼ਨ ਦਾ ਨਿਪਟਾਰਾ ਕਰਦੇ ਹੋਏ ਕੀਤੀਆਂ ਗਈਆਂ ਸਨ&comma; ਜਿਸ ਵਿੱਚ ₹ ਦੀ ਫੀਸ ਦੀ ਵਸੂਲੀ ਲਈ ਦਾਇਰ ਸਿਵਲ ਮੁਕੱਦਮੇ ਦਾ ਫੈਸਲਾ ਕਰਨ ਵਿੱਚ TNPSFDC ਦੀ ਸਹਾਇਤਾ ਦੀ ਮੰਗ ਕੀਤੀ ਗਈ ਸੀ। ਮਾਪਿਆਂ ਤੋਂ ₹76&comma;275 &lpar;ਅਕਾਦਮਿਕ ਸਾਲ 2018-19 ਤੋਂ 2020-21 ਲਈ&rpar;&comma; 12&percnt; ਪ੍ਰਤੀ ਸਾਲ ਦੀ ਦਰ ਨਾਲ ਵਿਆਜ ਨਾਲ।<&sol;p>&NewLine;<p>ਆਸਨ ਮੈਮੋਰੀਅਲ ਸੀਨੀਅਰ ਸੈਕੰਡਰੀ ਸਕੂਲ ਦੇ ਵਿਦਿਆਰਥੀ ਦੇ ਮਾਪਿਆਂ ਦੀ ਨੁਮਾਇੰਦਗੀ ਕਰ ਰਹੇ ਐਡਵੋਕੇਟ ਐਮ&period; ਪੁਰਸ਼ੋਤਮਨ ਨੇ ਜੱਜ ਦੇ ਧਿਆਨ ਵਿੱਚ ਲਿਆਂਦਾ ਕਿ ਸੂਬੇ ਦੇ ਸਾਰੇ ਪ੍ਰਾਈਵੇਟ ਸਕੂਲ ਆਪਣੀ ਫੀਸ ਦਾ ਢਾਂਚਾ ਖੁਦ ਤੈਅ ਕਰ ਰਹੇ ਹਨ ਅਤੇ ਵਿਦਿਆਰਥੀਆਂ ਤੋਂ ਸਾਲਾਨਾ ਫੀਸਾਂ ਵਸੂਲ ਰਹੇ ਹਨ। 2009 ਤੱਕ ਮਹੀਨਾਵਾਰ&comma; ਜਾਂ ਅਵਧੀ ਦੇ ਆਧਾਰ &&num;8216&semi;ਤੇ&comma; ਜਦੋਂ ਰਾਜ ਵਿਧਾਨ ਸਭਾ ਫੀਸ ਢਾਂਚੇ ਨੂੰ ਨਿਯਮਤ ਕਰਨ ਲਈ ਇੱਕ ਕਾਨੂੰਨ ਲੈ ਕੇ ਆਈ ਸੀ।<&sol;p>&NewLine;<p>ਸੀਬੀਐਸਈ ਅਤੇ ਆਈਸੀਐਸਈ ਸਕੂਲਾਂ ਦੇ ਇੱਕ ਸਮੂਹ ਨੇ 2010 ਅਤੇ 2012 ਦੇ ਵਿਚਕਾਰ ਮਦਰਾਸ ਹਾਈ ਕੋਰਟ ਵਿੱਚ ਕਈ ਰਿੱਟ ਪਟੀਸ਼ਨਾਂ ਦਾਇਰ ਕੀਤੀਆਂ ਸਨ ਜੋ ਉਨ੍ਹਾਂ ਦੀਆਂ ਸੰਸਥਾਵਾਂ ਵਿੱਚ ਕਾਨੂੰਨ ਦੀ ਲਾਗੂ ਹੋਣ ਨੂੰ ਚੁਣੌਤੀ ਦਿੰਦੇ ਸਨ। ਜਸਟਿਸ ਆਰ ਭਾਨੂਮਤੀ ਅਤੇ ਆਰ ਸੁਬੈਯਾ &lpar;ਦੋਵੇਂ ਹੁਣ ਸੇਵਾਮੁਕਤ&rpar; ਤਾਂ ਸੁਪਰੀਮ ਕੋਰਟ ਨੇ 28 ਜਨਵਰੀ&comma; 2016 ਨੂੰ ਅੰਤਰਿਮ ਰਾਹਤ ਦਿੱਤੀ&comma; ਇਹ ਪੜ੍ਹਿਆ&colon; &&num;8216&semi;ਅਸੀਂ ਨਿਰਦੇਸ਼ ਦਿੰਦੇ ਹਾਂ ਕਿ ICSE ਅਤੇ CBSE ਸਕੂਲਾਂ ਲਈ&comma; ਫੀਸ ਕਮੇਟੀ ਦਾ ਰੈਗੂਲੇਟਰੀ ਵਿਧੀ ਸੀਮਤ ਰਹੇਗੀ। ਤਾਮਿਲਨਾਡੂ ਸਕੂਲ &lpar;ਫ਼ੀਸਾਂ ਦੀ ਉਗਰਾਹੀ ਦਾ ਨਿਯਮ&rpar; ਐਕਟ&comma; 2009 ਦੀ ਧਾਰਾ 7&lpar;3&rpar; ਅਧੀਨ ਮੌਜੂਦਾ ਵਿਵਾਦ ਦਾ ਲੰਬਿਤ ਵਿਚਾਰ ਅਧੀਨ ਹੈ।&&num;8221&semi;<&sol;p>&NewLine;<p>ਸੁਪਰੀਮ ਕੋਰਟ ਦਾ ਅੰਤਰਿਮ ਹੁਕਮ ਇਹ ਸਪੱਸ਼ਟ ਕਰਦਾ ਹੈ ਕਿ ਅਪੀਲ ਦੇ ਨਿਪਟਾਰੇ ਤੱਕ ਟੀਐਨਪੀਐਸਐਫਡੀਸੀ ਸੀਬੀਐਸਈ&sol;ਆਈਸੀਐਸਈ ਸਕੂਲਾਂ ਲਈ ਫੀਸਾਂ ਨਿਰਧਾਰਤ ਨਹੀਂ ਕਰ ਸਕਦੀ&comma; ਪਰ ਕਮੇਟੀ ਹਮੇਸ਼ਾਂ ਇਹ ਪੁਸ਼ਟੀ ਕਰ ਸਕਦੀ ਹੈ ਕਿ ਫੀਸਾਂ ਉਨ੍ਹਾਂ ਦੁਆਰਾ ਦਿੱਤੀਆਂ ਜਾਂਦੀਆਂ ਸਹੂਲਤਾਂ ਦੇ ਅਨੁਕੂਲ ਹਨ ਜਾਂ ਨਹੀਂ&quest; ਇਸ ਲਈ&comma; ਸਹਾਇਕ ਸਿਟੀ ਸਿਵਲ ਕੋਰਟ ਨੇ ਕੇਸ ਦਾ ਫੈਸਲਾ ਕਰਨ ਵਿੱਚ TNPSFDC ਦੀ ਸਹਾਇਤਾ ਲੈਣ ਦਾ ਫੈਸਲਾ ਕੀਤਾ ਸੀ&comma;
